An abstract of judgment is a summary of a judgment that is prepared by the clerk of the court and then recorded in the property records of the county in which the judgment debtor is believed to own or have an interest in real property.

It is active for 10 years and can be renewed if the have attempted to execute on the judgment. They will not be able to foreclose on the homestead unless the homestead looses its status as homestead.

The purpose of an abstract of judgment is to create a public record and create a lien or claim if necessary on any real estate owned or later acquired by the loser located in the county in which the abstract of judgment is recorded.

Complete an Abstract of Judgment (EJ-001). Have it issued by the clerk and pay the issuance fee by submitting the document to the court location where your case was filed or you may also submit the document by eFile. Give the original issued Abstract to the County Recorder and pay their recording fee.

An abstract of judgment does not expire; it lasts as long as the judgment lasts which, in California, is 10 years from the date the judgment was entered. After 10 years, you can renew the judgment for a second 10-year period by filing the appropriate forms.

In California, the Abstract of Judgment is a Judicial Council form that can be downloaded from any court website (Form EJ-001). The form asks for information regarding the debtor's name, last known address, driver's license number, and the amount of money the debtor owes you.

The debtor must get a discharge or release of the abstract of judgment to remove the lien from the home. Contact the judgment creditor shown on the abstract. Arrange to pay the debt in full or negotiate payments. Ask the creditor for a discharge if paying in full.

To do this, fill out an EJ-001 Abstract of Judgment form and take it to the clerk's office. After the clerk stamps it, record it at the County Recorder's Office in the county where the property is located. Place a lien on a business.
