If you are serving as the personal representative (executor) of someone's estate, you might be wondering how quickly after their death you must file probate. Unlike some states, Michigan does not have a required filing deadline for a probate case.

When an estate is under unsupervised administration, it can be closed with a Petition for Complete Estate Settlement. Or you can use the Sworn Statement to Close Unsupervised Administration to close the estate. But you will also need to file a Certificate of Completion.

Informal probate typically takes less than a year, and may take less than six months. However, if it extends for more than a year, you will need to file a Notice of Continuing Administration.

What Is Michigan Informal Probate? The Michigan Informal Probate process is completed before a Probate register, so it is generally simpler and more cost-efficient than Formal Probate. Michigan Informal Probate can be thought of as an administrative process that does not require court oversight or formal hearings.

File the form, the decedent's will (if there is one), and a certified copy of the death certificate with the county probate court where the decedent lived. If the decedent did not live in Michigan but owned real property in Michigan, file the documents in the county where the real property is located.

A Michigan Personal Representative is appointed by the Probate Court to guide a decedent's estate through the Michigan Probate process. They are in charge of managing and distributing the estate to the decedent's heirs. The estate includes the debt, money, and property the decedent owned at the time of their death.

Does having a will avoid probate in Michigan? A will allow you to choose how you want your estate distributed after death. It does not avoid probate. A will must be “probated” in a probate court in Michigan.

Informal Probate in Michigan Informal probate proceedings are less costly and time-consuming than formal proceedings, but there are fewer safeguards than formal proceedings. The informal proceeding involves fewer steps and is completed in front of a probate register, rather than a judge.
