What it is & how it works. Details about the delayed closing warranty are provided in the Tarion Addendum, which your builder is required to attach to your purchase agreement. The first page of the Addendum to your purchase agreement is a Statement of Critical Dates which must be signed by both you and your builder.

The Firm Occupancy Date — is the date the condominium unit will be completed. This date is agreed upon by the builder and the buyer. The Outside Occupancy Date — if the builder fails to meet the Firm Occupancy Date, they must set what is referred to as an outside occupancy date or outside closing date.

The occupancy date is the date you can move in after construction is done. It can be found in the Condominium Home Addendum, which is a document that is part of the purchase agreement and contains the Statement of Critical Dates. The Statement of Critical dates must be signed by both the buyer and by the builder.

Tentative Occupancy Date A projected target date as to when your suite will be complete, and you can take occupancy. This initial date is established as part of your Agreement of Purchase and Sale and is the most optimistic date of completion.

“First Tentative Occupancy Date” means the date on which the Vendor, at the time of signing the Purchase Agreement, anticipates that the home will be complete and ready for Occupancy, as set out in the Statement of Critical Dates.

First Tentative Occupancy Date is the date that the builder anticipates the condominium unit will be completed and ready to move-in, as agreed upon by you and the builder. Your builder can set one or more Tentative Occupancy dates.
