PennDOT issues a variety of different Highway Occupancy Permits (HOPs) to property owners, developers, utility companies, municipalities and municipal authorities, and other interested parties who desire access to the state's right-of-way.

WHAT IS A HIGHWAY OCCUPANCY PERMIT (HOP)? An HOP is used to complete projects within PennDOT right-of-way. Projects may include constructing a driveway, installing a utility, or other structures such as curbs, sidewalks and drainage facilities.

(a) General rule. No driveway, local road or drainage facility or structure shall be constructed or altered within State highway right-of-way and no drainage facility of the Department may be altered or connected onto without first obtaining a permit from the Department. A permit may not be required for maintenance.

Occupancy Permit Duly accomplished Certificate of Completion, signed by owner / applicant, signed and sealed by respective architect / engineers, Forms are available at the Office of the Building Official. Photocopy of all Approved Permit Application Forms (Back & Front) Copy of Approved Construction Plans / Blueprints.

A Certificate of Occupancy is a formal approval, in writing by the Building Code Official, that a specified structure is satisfactorily code compliant for inhabitants to occupy and to be utilized as intended per the approved use.

While the right-of-way is often 33 feet wide, it may be much wider (120 feet or more in some cases), since it extends beyond the paved road and shoulders. Contact the PennDOT District office to find out what the right-of-way width is for a specific location.

​A permit is required when a driveway, local road or drainage facility, utility facility, or structure is constructed or altered within state highway right-of-way and may alter or need to be connected to a PennDOT drainage facility.
