About Certificates of Occupancy Every new business, tenant, or building is required to have a Certificate of Occupancy. This certificate indicates that the building or tenant meets the minimum adopted building and fire codes.

Who Is Responsible For The Certificate Of Occupancy In New Jersey? Generally, the person responsible for the certificate of occupancy is the owner of the property or the landlord. However, the terms of the lease may require both the tenant and the property owner to obtain the certificate.

Certificates of occupancy are not required in New Jersey for all sales. A “temporary certificate of occupancy” may be granted for a set time period to accomplish necessary repairs. A “certificate of transfer title” is sometimes used to transfer ownership where a property fails the municipal inspection.

A TCO is the easiest to obtain, and the whole process takes about 6 months, or more, to complete. All you need are temporary approvals from the NYC DOB on the following essential items: Temporary Construction Sign Off.

A Certificate of Occupancy is required for all rental properties-before a tenant can move in-to ensure the premises are up to code. It is the landlord's responsibility to have a CO each time a tenant changes.

New buildings must have a CO, and existing buildings must have a current or amended CO when there is a change in use, egress or type of occupancy. No one may legally occupy a building until the Department has issued a CO or Temporary Certificate of Occupancy (TCO).

A Certificate of Continuing Occupancy (CCO) is also required for every non-residential property whenever a change in occupancy occurs; which involves re- inspection of all areas of life safety. Construction permits must be obtained for all proposed modifications.
