Do I need a solicitor to evict a tenant? You don't need to use a solicitor to recover possession of your property as people can deal with the court directly, however, there are a signification number of obligations and rules that need to be met before a valid notice can be given to a tenant to end your tenancy.

You must follow a set process if your tenants have an assured shorthold tenancy. Give your tenants a Section 21 notice if you want the property back after a fixed term ends. ... Apply to the court for a standard possession order if your tenants do not leave by the date specified on the notice and they owe you rent.

Form 6A: for a no fault possession notice on an assured shorthold tenancy. This form should be used where a no fault possession of accommodation let under an assured shorthold tenancy is sought under section 21(1) or (4) of the Housing Act 1988.

If there is no tenancy agreement, a tenant cannot be given a section 21 notice for eviction. Instead, a landlord must use a section 8 notice (with a ground for eviction). To be able to evict a tenant in the absence of a written tenancy agreement, a landlord will need to apply to the courts for a possession order.

This means the eviction process will be prolonged. The government has introduced new legislation which means that from 29 August 2020 landlords must provide 6 months' notice prior to seeking possession through the courts in most cases, including Section 21 notice and rent arrears under 6 months.

FORM NO. 3. Housing Act 1988 section 8 (as amended) INFORMATION FOR THE TENANT. This notice tells you that your landlord intends to begin proceedings for possession of the property identified in section 2.
