In order to ask for IFP status, you must file a "PETITION AND AFFIDAVIT TO PROCEED IN FORMA PAUPERIS" with the Court, in which you give the Judge detailed information about your financial situation. The required form is attached to these instructions, along with a form order for the Judge.

By statute you can have up to 30 days to pay your fines and costs. You must ask the Judge for time to pay; the Judge can even give longer than the 30 days. It requires an extra fee but it allows you the time you need to take care of the fines and costs.

But if you have a low income, you might be able to file your documents in court without the payment or with a lower payment if you first file a “poverty affidavit.” A poverty affidavit is a written, sworn statement that you have a low income and do not have enough money to pay fees.

You may file a motion to proceed as a poor person (in forma pauperis) and an affidavit of financial status with the District Court. The judge who heard your case will rule on whether or not you can proceed on appeal without paying the filing fee.

To request a discretionary court costs waiver, file an Affidavit of Indigency and Motion to Proceed In Forma Pauperis. If the Court denies a discretionary waiver, advise the client of his/her responsibility for costs.

Signing an entry of appearance and waiver of service only means that the party signing the document is giving up his/her right to be served by a sheriff's deputy. It does not mean they agree with the lawsuit or are giving up their right to notice of when any hearings are to be held.

Most district courts require the filing of a motion or application, affidavit of the party, and the proposed complaint to be filed in the case. The affidavit of the party should include all assets and income available to the party and establish that the individual is unable to pay for fees in the action.

(b) For all cases filed on or after the effective date that the court or division becomes subject to this Court Operating Rule 21.03, the court or division shall collect court costs, fees, miscellaneous charges, and surcharges ing to a schedule approved by this Court.
