An encroachment permit grants permission to the permittee or their agent (a contractor) to perform the within the State's right-of-way, and assignment to another party is prohibited. An encroachment permit is not a property right, such as an easement, nor does it confer a property right.

A permit is required whenever work is performed within any public street, highway, alley, sidewalk or other platted or written easement, otherwise known as the “right-of-way”, which has been dedicated to, or accepted by, or acquired by, the City for public purposes.

Encroachment Permits are used for a broad range of activities that occur in or upon the County Right- of- Way (public streets, roads, sidewalks, and alleys). Activities in the Right-of-Way (ROW) such as special events, filming, and storage of equipment/materials may all require an encroachment permit.

A building permit is required for most non-residential construction, new homes, and when existing homes are remodeled or additions are made. The permit is issued when structures are designed in ance with the building codes and all other applicable codes and ordinances, to ensure the safety of the structure.

The purpose of an encroachment permit is to enable the City to monitor work or activities performed within City rights-of-way by home owners, private developers, contractors, utility companies and local governmental agencies and to ensure the safety of the public.
