Arbitration is one of the most emblematic and growing forms of ADR. Arbitration is more formal than mediation and has a lot of similarities with traditional court proceedings, involving limited discovery and simplified rules of evidence (ex. hearsay is usually admissible in arbitration).

Parties can become involved in the arbitration process in one of three ways: judicial arbitration, contractual arbitration or by stipulation.

Types of ADR. The most common types of ADR for civil cases are mediation, settlement conferences, neutral evaluation, and arbitration.

Arbitration, much like mediation or negotiation, is an alternative dispute resolution (“ADR”) method. ADR methods represent alternatives to traditional litigation. Thus, when parties agree to an arbitration, they take the matter of dispute out of a state or federal court.

Through the IIROC Arbitration Program, arbitrators can award up to $500,000, but no more. And under IIROC rules, your firm must comply with the arbitrator's decision. What if my investment firm doesn't want to take part in arbitration? It is up to you to decide whether to take your complaint to arbitration.

Is arbitration a form of ADR? Arbitration is the judicial determination of a dispute by an independent third party called an arbitrator. Put simply, it is not technically a form of ADR.

Types of ADR include arbitration, mediation, negotiated rulemaking, neutral factfinding, and minitrials. With the exception of binding arbitration, the goal of ADR is to provide a forum for the parties to work toward a voluntary, consensual agreement, as opposed to having a judge or other authority decide the case.

Alternative Dispute Resolution ("ADR") refers to any means of settling disputes outside of the courtroom. ADR typically includes early neutral evaluation, negotiation, conciliation, mediation, and arbitration.
