A Writ of Garnishment is an order that makes the actual garnishment happen. In Washington, the creditor must wait 10 days in superior court (Rule CR 62) and 30 days in district court before they can serve the Writ of Garnishment.

There are two ways to stop garnishment in Virginia. One way is by filing for bankruptcy, which will stop all garnishments and other collection efforts. The other way is by filing for an exemption, which will exempt you from garnishment but not bankruptcy.

You may request an exemption to the garnishment. You must make your request within 30 days of when the garnishment was served on the bank. Use the form Motion for Release of Property from Levy/Garnishment (DC-CV-036).

Rule 3-645.) You may be entitled to claim an exemption of all or part of your money or property, but in order to do so you must file a motion with the court as soon as possible. If you do not file a motion within 30 days of when the garnishee was served, your property may be turned over to the judgment creditor.

The written objection should include: the case number (a unique set of numbers or letters specific to your case) your name, address, and phone number. a detailed explanation of your reasons for challenging the garnishment. a request for a hearing if the court has not already set a hearing date.

Worker's compensation benefits, retirement income, annuities, and life insurance are also exempt from wage garnishment. Also, child support and alimony (spousal support) payments are generally exempt from wage garnishment orders.

After you obtain a judgment, you file a Request for Writ of Garnishment of Wages (DC-CV-065). To complete the form, you need to know the name and address of the debtor's employer, the amount of the judgment and any additional money owed (such as court costs and interest.)

This Writ with Notice is a Court order which may cause your property or money to be held and taken to pay a judgment entered against you. You have legal rights which may prevent all or part of your money or property from being taken. That part of the money or property which may not be taken is called “exempt property”.
