Trusts are a common means of holding real estate. When placed into a trust, the trust becomes the owner of the property. Trusts, importantly, can sue, and be sued in Massachusetts courts.

Trusts are either revocable or irrevocable. As suggested by its name, a revocable trust is a trust that can be modified or revoked by the settlor after it has been signed. An irrevocable trust, on the other hand, cannot be modified or revoked by the settlor once it has been signed.

Challenging a living trust in Massachusetts is different from challenging a will. To contest a trust, you must file a lawsuit in the Probate or Superior Court. Living trusts are complex documents which require an even higher level of testamentary capacity than a will.

A trust shall be subject to the jurisdiction of the probate and family court department of the trial court of the commonwealth in the county where its principal place of administration is located.
