A survival action, governed by 42 Pa. C.S.A. Section 8301, is simply when the decedent's estate stands in the shoes of the person who has passed away. The personal representative for the estate is able to bring the same claims that the decedent could have brought if they were still alive.

Unlike a wrongful death lawsuit, a survival action involves recovering pre-death damages that the victim could have recovered if they had lived. In other words, a survival action allows individuals to pursue a personal injury claim on behalf of their deceased family member.

In Pennsylvania, a survival action is brought by the personal representative of the decedent's estate in order to recover the loss to the decedent's estate resulting from the defendant's tort or crime.

Many people do not realize that the only people who can qualify as beneficiaries under a wrongful death claim are spouses, children, and parents of the decedent (provided they can show a pecuniary loss).

Under the Florida survival statute, “No cause of action dies with the person. All causes of action survive and may be commenced, prosecuted, and defended in the name of the person prescribed by law.” Unlike a wrongful death claim, a survival claim does not consider the impact of the person's death on the family.

A wrongful death lawsuit is brought on behalf of the spouse, parents or children. In contrast, a survival action is brought on behalf of the deceased person by the personal representative of the estate.

A survival action is the lawsuit that the deceased person would have been able to bring had he or she lived, while a wrongful death action is a claim for compensation for the harms that the family of the deceased has suffered.

In a survival action, the personal representative, administrator, administratrix, executor, or executrix of the decedent's estate may bring the survival action arising from an accidental or wrongful death.

A survival action is the lawsuit that the deceased person would have been able to bring had he or she lived, while a wrongful death action is a claim for compensation for the harms that the family of the deceased has suffered.

While both involve the death of someone due to another's actions, wrongful death and murder are two very different matters. Wrongful death is a civil claim, and murder is a criminal offense. A wrongful death claim is separate from a murder case, even if the responsible party was found to be criminally liable.
