The Baker Act is a Florida law that enables families and loved ones to provide emergency mental health services and temporary detention for people who are impaired because of their mental illness, and who are unable to determine their needs for treatment.

The Marchman Act is also a Florida law but is invoked for individuals who are deeply impaired by a substance use disorder. Each act lasts for different periods of time. For example, when someone is Baker Acted, he or she can only be involuntarily held for 72 hours for an examination.

The petition may only be filed by: You must provide the court with sworn written testimony before a notary that meets the criteria set forth by Florida law. The person must be in the county where the petition is filed and cannot be in jail. Include the person's health insurance information, if any, in the petition.

The average cost is $300 a day per bed regardless of whether there is someone receiving treatment. This is to guarantee that anyone who needs help can get it.

It can be initiated by judges, law enforcement officials, or mental health professionals. There must be evidence that the person a) has a mental illness (as defined in the Baker Act) and b) is a harm to self, harm to others, or self neglectful (as defined in the Baker Act).
