A teacher and instructional assistant are both in the classroom. A kindergarten classroom is required to have a bathroom so it is typically housed in a traditional classroom.

Virginia's compulsory attendance law (§22.1-254, subsection A) states that all children who are 5 years old on or before September 30 of the school year must attend school. This could include public school, private school, a public or private preschool program, a private tutor, or home instruction.

Section 22.1-1 of the Code defines a person of school age as “a person who will have reached his fifth birthday on or before September 30 of the school year and who has not reached twenty years of age on or before August 1 of the school year.”

Children who will be 5 years old by September 30 of a given year are eligible to enter kindergarten. By the previous March, families should determine the school that their child will attend and contact the school to make arrangements for enrollment.

In middle and high schools, a student may fail or lose credit if unlawful absences exceed 5 days in a term, 10 days in a semester or 20 days in a school year. A note from a doctor, dentist, court official or counselor may be required for all absences beyond 10 days.

PreK is a full-day program that primarily serves income-eligible children who are four years old by September 30.
