Are CalPERS disability retirement benefits taxable? CalPERS reports all non-industrial disability retirement as ordinary income, meaning that it is generally going to be subject to both Federal (IRS) and State (California) income Tax.

The only type of pension that CalPERS reports to tax authorities as “tax exempt” is the industrial disability retirement allowance, which applies only to safety category employees, such as police and firefighters where the job itself requires risk to their personal safety.

If you are retired on disability, benefits you receive under your employer's disability retirement plan are considered earned income until you reach minimum retirement age. However, payments you received from a disability insurance policy that you paid the premiums for are not earned income. More information.

Disability retirement is a monthly retirement allowance payable to the member for life, or until recovery from the disabling injury or illness. The disability does not have to be permanent, however, it must last at least 12 consecutive months.

Your retirement benefit is calculated using a formula with three factors: Service credit (Years) multiplied by your benefit factor (percentage per year) multiplied by your final monthly compensation equals your unmodified allowance. Service Credit - Total years of employment with a CalPERS employer.

Once all the necessary information has been received, we will apply CalPERS criteria to determine the member's medical qualifications for disability retirement. The disability retirement process can take up to 4-6 months. It is very important for a member to be as thorough as possible when completing the application.

If your employer has an agreement for the improved disability retirement (Government Code section 21427), your Unmodified Allowance will be 30 percent of your final compensation for the first five years of service credit, plus 1 percent for each additional year, to a maximum of 50 percent .

Retirees' monthly retirement benefit payments are treated as ordinary income. Unless you specify the income tax withholding election you want applied to your benefit, federal and/or California state income tax will be withheld from your benefit payment as the default filing status defined in the tax form instructions.
