The LCSA will handle getting an Income Withholding Order. They will have the order served within 15 days of locating the other parent's employer. Once the employer receives the Order, they have 10 days to take the money from the parent's next paycheck. The employer must send the money to the SDU.

An income withholding order is an order directing an employer or other payor of funds to withhold a monthly amount from the income of the person obligated to pay child support, spousal maintenance, child support and spousal maintenance arrearage, and/or interest.

Income Withholding for Support (FL-195) Tells an employer that the court made an order for you or the other person in the case to pay child support, medical support, spousal or domestic partner support (and any past-due support).

The withholding limits set by the federal CCPA are: 50 percent - Supports a second family with no arrearage or less than 12 weeks in arrears. 55 percent - Supports a second family and more than 12 weeks in arrears. 60 percent - Single with no arrearage or less than 12 weeks in arrears.

Income withholding is a process that deducts child support payments automatically from the noncustodial parent's paycheck, like taxes. When a child support order is established, the child support agency sends an income withholding notice to the noncustodial parent's employer.

(b) The income deduction order shall: 1. Direct a payor to deduct from all income due and payable to an obligor the amount required by the court to meet the obligor's support obligation including any attorney's fees or costs owed and forward the deducted amount pursuant to the order.
