An Endangered Species Act Section 10(a)(1)(B) Incidental Take Permit is required for any "take" of an endangered or threatened species incidental to, and not the purpose of, an otherwise lawful activity.

Incidental Take Permits allow a permittee to take a CESA-listed species if such taking is incidental to, and not the purpose of, carrying out an otherwise lawful activity. These permits are most commonly issued for construction, utility, transportation, and other infrastructure-related projects.

ESA Section 10(a)(1)(A) allows NOAA Fisheries to issue permits for the purposeful or direct take of an ESA-listed species only for scientific purposes or to enhance the propagation (such as through hatcheries) or survival of listed species.

Critical Habitat Designation Process We are required to designate critical habitat based on the best available scientific data. We must also consider the economic, national security, and other relevant impacts of specifying a particular area as critical habitat.

An Endangered Species Act Section 10(a)(1)(B) Incidental Take Permit is required for any "take" of an endangered or threatened species incidental to, and not the purpose of, an otherwise lawful activity.

Section 10 of the Endangered Species Act (ESA) allows for the development of Habitat Conservation Plans (HCPs), which result in Incidental Take Permits that give exceptions to the prohibition against "take" of a listed species.

Both Section 7 and Section 10 allow for incidental take, whether through a statement or a permit. The major difference between Section 7 and Section 10 is who is involved - federal agencies vs. private, state and local landowners - and how incidental take is dealt with - via statement or permit.

A Habitat Conservation Plan (HCP) is a planning document designed to accommodate economic development to the extent possible by authorizing the limited and unintentional take of listed species when it occurs incidental to otherwise lawful activities.
