A home buyer can withdraw an offer at any time until the offer is accepted by the home seller. After that, the seller may owe a commission to the broker, and may sue the buyer for breach of contract to recover the cost of that commission.

A buyer can walk away though at any time from the contract up until the actual signing of all documents at closing.

Once signed by both buyer and seller, your offer to purchase becomes a legally binding sales contract, at which point you can no longer withdraw your offer unless certain contingencies are not met. For instance, if your loan does not go through, you are not obligated to purchase the home.

The buyer will usually not be able to cancel the OTP after both parties have signed without any consequences, unless the OTP specifically provides for this. One of the few exceptions would be if the provisions of a suspensive condition are not met.

A buyer should not use the WB-46 Multiple Counter-Proposal for negotiating with a seller. If a buyer agrees to all of the seller's terms included in the proposal, the buyer signs and dates the proposal. Lines 36-39 are for buyer identification, signatures, and dates.

The buyer can cancel an offer to purchase, but doing so will be extremely costly. The buyer may lose their deposit. The seller may claim damages. The buyer will be liable for the agent's commission.

What Happens if the Buyer or Seller Pulls out of a House Sale? In short, if the signature of the Seller and Buyer (or their Agent) appear on the offer to purchase, then both parties are bound to honour the contractual agreement. Not doing so puts you in breach of said contract.

Yes — if you back out of a signed contract for a reason not explicitly stipulated as a contingency, not only do you risk losing your earnest money, but the seller could possibly seek further legal action. It's easier to back out of buying a house before the purchase agreement is signed.
