A temporary protection order (TPO) in Nevada is a 45-day long retraining order that courts issue on an emergency basis without holding a hearing.

An Order of Protection is a document issued by a court and signed by a judge to help protect you from harassment or abuse. In an Order of Protection, a judge can set limits on your partner's behavior. Among other things, a judge can: Order your partner to stop abusing you and your children.

An extended order may award permanent custody and address visitation. A temporary protection order may last up to 45 days or until the hearing on the extended order. The judge may extend that period under limited circumstances. The court can issue an extended order that lasts for up to two years after a hearing.

If the judge issues the TPO, the court will arrange for the “adverse party” to be served (notified) with a copy of the order. The TPO remains in effect for 45 days.

Criminal Records are Public Knowledge An arrest for domestic violence and a subsequent restraining order will appear on your record even if the charges are dropped. In Nevada, criminal records are public knowledge and your history will show up in background checks.

At the hearing, you must prove that the abuser has committed an act(s) of domestic violence (as defined by the law). You must also convince a judge that you need the protection and the specific things you asked for in the petition.

There are no fees for filing an order for protection against domestic violence or for getting a certified copy of the order.

Any person who believes she or he has been, or might become a victim of Domestic Violence may ask the Second Judicial District Court for a T.P.O. For any questions you have about the process, please contact the Protection Order Help Center at (775) 328-3127 or email to: pohc@washoecourts.us.
