Florida's current minimum wage rate is $10.00. In November 2020, Florida voters approved a measure allowing for incremental increases to the minimum wage. Beginning September 30, 2022, and until September 29, 2023, Florida's minimum wage is $11 per hour. The tip minimum wage is $7.98.

If there is a finding of wage theft, he or she will order the employer to pay wage restitution to the employee in an amount equal to three times back wages as well as actual administrative and processing costs to the Board of County Commissioners.

If an employer is found to have unlawfully failed to pay earned wages, the employee will be entitled to receive three times the amount of back wages that the employer is found to have unlawfully failed to pay the employee.

State Minimum Wage Violations The statute of limitations for any wage violations related to Florida's Minimum Wage Act is four years. However, if your employer willfully violated the Minimum Wage Act, the statute of limitations increases to five years.
