The main objective of the EEA4 form is to collect information from the employer to assess the remuneration gap between the highest paid and lowest paid employees. This exercise also enables an assessment into inequalities in remuneration in terms of race and gender at the different occupational levels.

Section 6(4) of the EEA reads: “A difference in terms and conditions of employment of employees with the same employer performing the same or substantially the same work or work of equal value that is directly or indirectly based on any one or more of the grounds listed in Subsection (1) is unfair discrimination”.

Examples of this are – race, gender, ethnic or social origin, colour, sexual orientation, age and disability, etc. Discrimination can be direct or indirect.
