If you own a Texas business and would like to use a different name than your legal business name, you will need to register a “doing business as” or DBA name with the state. In Texas, this is called an assumed name, and other terms for DBAs also include fictitious business names and trade names.

What is the difference between a “DBA” or “Doing Business As” and an “FBN” or “Fictitious Business Name”? They are generally different names for the same thing. DBA is the more common name, though FBN is cited in the relevant California statutes (California Business and Professions Code Section 17910, et seq.)

Assumed Name Certificates in Texas An assumed business name is a name for your business that is different than its legal registered name. An assumed business name certificate is the document that serves as proof that your company has the legal right to use a specific name.

A trade name is used for advertising or trade purposes. A fictitious name (sometimes called a d/b/a or "doing business as" name) is a name registered with your city or county to let people know who owns the business.

Businesses that conduct business under a name that is not their legal name need a Certificate of Assumed Name. This certificate is also called the "doing business as (DBA) certificate." Businesses must file the certificate with the New York State Department of State (NYSDOS).

After you set up a DBA in New York City successfully, that's it. There are no annual renewal requirements; the trade name is yours for the foreseeable future. If you decide to cancel an assumed name for a corporation or LLC, you'll file a Certificate of Discontinuance with the state and pay a $25 fee.

Instead of using a legal name, a person or business can do business under assumed names. For example, foreign companies that intend to operate in New York State need to use a fictitious name if their original name is already in use by a domestic New York entity.

Depending on the state or local statute, an alias or an assumed name may be defined as: a doing business as d/b/a name, a fictitious name, an assumed name, or a trading as t/a name. There is no universal titling or designation for an alias or an assumed name.
