If you have real estate in California that you want to convey or transfer to someone, you can use either a quitclaim deed or a warranty deed. The difference between the deeds is substantial, so it's important to know which to use for your particular situation.

A Colorado quit claim deed allows a property owner (the “grantor”) to relinquish interest in a property to another party (the “grantee”) without any warranties of title. The grantee assumes all risk with this deed and can take no legal action against the grantor should any title issues arise.

What is the cost to file a Colorado deed? The person requesting recording of a Colorado deed must pay a filing fee of $13.00 for the first page and $5.00 for each additional page. The filing fee includes a $3.00 surcharge earmarked for Colorado's electronic recording filing fund.

To write a Colorado quitclaim deed, you will need to provide the following information: Name and address of the preparer. Name and address of the party that will receive tax notices. Amount of consideration given for the property. Grantor's (person selling or gifting the property) name, marital status, and address.

Laws. Signing (§ 38-35-103) – The quitclaim deed in Colorado must be acknowledged in front of a notary public.

Florida law requires that the grantor must sign the deed in the presence of two witnesses and a notary public. The witnesses must also sign in the presence of the notary.

A signature witness must be an adult (over the age of 18), be of sound mind, not under the influence of drugs, and not be a party to the deed or have any financial interest in it. Outside of these minimal requirements, there is little else governing who can be a witness to a deed.

Do not let their lack of formality deceive you: Quitclaim Deeds are still legal documents with legal implications. If you are planning to use a quitclaim deed or are confronted with one in a real estate transaction, you must have an experienced Real Estate Attorney who can advise you ingly.

The current owner signing a quitclaim deed—the grantor—makes no promises as to the real estate's title. The new owner—the grantee—therefore bears the risk of any known or unknown title problems. The total absence of warranty of title is what distinguishes quitclaim claim deeds from other Colorado deed forms.

A seller can allow a buyer's attorney to prepare the deed or the seller can retain a Daytona real estate attorney to represent the seller during the real estate closing process. All deeds executed in Florida must be signed in the presence of a notary public and two witnesses.
