Colorado's Required Notice for Separating Employees—New Form Released. In May 2022, Colorado passed a new law requiring employers to provide a notice to all separating employees alerting them that unemployment compensation benefits may be available.

8-2-122(2) The affirmation requirements must be met within 20 calendar days after hiring a new employee. Effective on and after January 1, 2007, within 20 days after hiring a new employee, each employer in Colorado shall keep a written or electronic copy of the affirmation for the term of employment for each employee.

The traditional rule in Colorado is that, absent an agreement or statute providing otherwise, the employer-employee relationship is “at-will,” meaning either party may terminate the relationship without notice at any time, for any reason or no reason at all.

As of January 1, 2023, Colorado employers and employees must contribute premiums to the FAMLI program, which will be available to begin paying benefits to employees beginning on January 1, 2024. Most eligible employees will receive up to twelve weeks of leave.

Colorado law states that any employer who provides information about a current or former employee's job history or job performance to a prospective employer of the current or former employee is immune from civil liability and is not liable in civil damages for the disclosure or any consequences of the disclosure. 2.

Retaining the Affirmation Form Employers must keep completed affirmation forms the entire time the worker is an employee. Employers must give copies of affirmation forms to the Colorado Division of Labor when asked; forms don't have to be submitted without request.

Use Form I-9 to verify the identity and employment authorization of individuals hired for employment in the United States. All U.S. employers must properly complete Form I-9 for each individual they hire for employment in the United States. This includes citizens and noncitizens.
