A contract for deed is an agreement for buying property without going to a mortgage lender. The buyer agrees to pay the seller monthly payments, and the deed is turned over to the buyer when all payments have been made.

The purchaser or lessee has the legal right to rescind (cancel) this agreement without cause or reason of any kind by sending or delivering a written notice of rescission to the seller or lessor by midnight of the seventh calendar day following the day the purchaser or lessee executed the agreement.

Many states require a cooling-off period of a few days (typically three business days) after any contract is signed. Either party may cancel the contract without penalty during this period.

Unless the land contract provides for a longer time, the buyer has 15 days after being served with the notice of forfeiture to cure the default (paying the amount that is past due). MCL 600.5728. Note: The seller cannot accelerate the entire amount due on the contract under the forfeiture process.

Unless there is a three-day right of rescission written expressly into the contract, there is no three-day right of rescission or “cooling-off” period under Arizona law.

If a buyer backs out of a contract without a valid reason, the buyer may be required to forfeit their earnest money or (lots) more. Indeed, under the contract utilized by most buyers and sellers in Arizona, there are two primary remedies available to a seller when a buyer improperly cancels a real estate contract.

Under Arizona law, consumers can cancel the following sales or services after the transaction is completed: Telephone Solicitation: You can cancel the order within three (3) business days from the delivery of the merchandise or premium (gift, bonus, prize or award) whichever is later. (A.R.S. §44-1276.

An Arizona land contract facilitates a transaction between a buyer and a seller for raw land. The contract acts as an offer the buyer presents to the seller for acceptance. Upon receiving, the seller will have the option to make a counteroffer, reject, or accept the terms of the agreement.
