Not all assets need to go through probate. Only assets that the deceased person owned in his or her own name, alone, must go through probate. All other assets pass to new owners without oversight from the probate court. Assets that go through probate make up what's called the "probate estate."

A will must be filed with the court in the county where the decedent lived. This record must be on file even if the estate doesn't need to go through probate. It allows the court to verify the validity of the will if anyone contests it.

No, in Tennessee, you do not need to notarize your will to make it legal. However, Tennessee allows you to make your will "self-proving" and you'll need to go to a notary if you want to do that. A self-proving will speeds up probate because the court can accept the will without contacting the witnesses who signed it.

Age: The testator must be at least 18 years old. Capacity: The testator must be of sound mind. Signature: The will must be signed by the testator or by someone else in the testator's name in his presence, by his direction.

A will must be filed with the court in the county where the decedent lived. This record must be on file even if the estate doesn't need to go through probate. It allows the court to verify the validity of the will if anyone contests it.

If a will was incorrectly executed, a court may invalidate it. Undue influence on the testator: When someone benefits by pressuring or intimidating a testator into signing a will – that might not otherwise have been signed – it's undue influence. If proven, undue influence may invalidate a will.

Tennessee currently recognizes three different types of wills: (1) attested wills; (2) holographic wills; and (3) nuncupative (oral) wills. Each of these categories have their own drafting and execution requirements that must be followed.

Tennessee does permit handwritten wills (Tennessee Code Ann. § 32-1-105), but they are usually not a good idea. Tennessee does also recognize nuncupative (oral) wills in very limited circumstances. To make an oral will, you must be in imminent peril of death and you must die from that peril.
