If you die, your widow or heirs, so long as they've been living there for five years, can complete the claim. If everybody but the baby dies, the kid is entitled to the proceeds of the sale of the land, after filing appropriate forms and fees, of course.

Landmark Legislation: The Homestead Act of 1862. To help develop the American West and spur economic growth, Congress passed the Homestead Act of 1862, which provided 160 acres of federal land to anyone who agreed to farm the land. The act distributed millions of acres of western land to individual settlers.

The new law established a three-fold homestead acquisition process: file an application, improve the land, and file for deed of title. Any U.S. citizen, or intended citizen, who had never borne arms against the U.S. Government could file an application and lay claim to 160 acres of surveyed Government land.

An amendment to the Homestead Act of 1862, the Enlarged Homestead Act, was passed in 1909 and doubled the allotted acreage from 160 to 320 acres (65 to 129 ha) in marginal areas. Another amended act, the national Stock-Raising Homestead Act, was passed in 1916 and granted 640 acres (260 ha) for ranching purposes.

The Homestead Act allowed African Americans, persecuted and famine-struck immigrants, and even women a chance to seek freedom and a better life in the West.

The 1862 Homestead Act accelerated settlement of U.S. western territory by allowing any American, including freed slaves, to put in a claim for up to 160 free acres of federal land.

The Homestead Act, enacted during the Civil War in 1862, provided that any adult citizen, or intended citizen, who had never borne arms against the U.S. government could claim 160 acres of surveyed government land. Claimants were required to live on and “improve” their plot by cultivating the land.

Passed on May 20, 1862, the Homestead Act accelerated the settlement of the western territory by granting adult heads of families 160 acres of surveyed public land for a minimal filing fee and five years of continuous residence on that land.
