The Family and Medical Leave Act (FMLA) provides certain employees with up to 12 weeks of unpaid, job-protected leave per year. It also requires that their group health benefits be maintained during the leave.

Employees must make reasonable efforts to schedule leave for planned medical treatment so as not to unduly disrupt the employer's operations. Leave due to qualifying exigencies may also be taken on an intermittent basis. Employees may choose or employers may require use of accrued paid leave while taking FMLA leave.

As long as your employer has enough employees, they are also required to reasonably accommodate your medical conditions—including by providing additional unpaid leave beyond the 12 weeks required by FMLA/CFRA. Your employer must provide additional leave unless doing so creates an “undue hardship” for the employer.

If your FMLA leave is exhausted and you decide to return to work, your employer cannot fire you solely because you took leave. The FMLA not only protects an employee's job, but it also provides protection against wrongful termination, wrongful penalization, and harassment against workers who take leave.

When employees exhaust twelve weeks of FMLA leave and still cannot return to work due to their own medical impairment, the employer may have an obligation under the ADA to grant additional unpaid leave as a reasonable accommodation, in some situations.

Exhaustion of Leave a. An employee who is absent from duty because of sickness or administratively approved emergency leave, and who has exhausted all leave entitlement and is still unable to return to duty, may use vacation, comp time or other available paid leave until it has been exhausted.

Intermittent FMLA leave is an option for employees who want to use FMLA leave in a more flexible manner. Intermittent leave involves the use of days or hours, broken down into increments, to care for a family member with a serious illness or to receive treatment for your own serious illness.
