The Offer to Purchase, commonly referred to as the OTP, contains all the terms and conditions of the sale, that are agreed upon between the buyer and the seller. Remember that this document is legally binding, so PLEASE take it seriously.

Simply put, this is not a good idea. The offer to purchase is a binding contract, and withdrawing from it will incur penalties. However, you can withdraw an offer to purchase if certain clauses in the contract have not been fulfilled.

This is a written contract that sets out the terms and conditions of the sale of a house (immovable property). 5.1. Transfer must be effected by a Conveyancer nominated by the Buyer, on the of 20 or as soon as reasonably possible.

The buyer stipulates the deadline date which the seller has to accept. If no deadline date is stipulated, the Offer to Purchase will be valid for what is termed “a reasonable period”. It's best to avoid this ambiguity by stipulating a deadline date. Buyers need to be aware of the 72-hour clause.

Can the buyer or seller cancel an offer to purchase? Yes, but it is a legally binding document, and doing so will incur penalties. Unless: A condition or clause included in the offer to purchase hasn't been met by one of the parties.

An Offer to Purchase is a legally binding contract; once you sign it, you cannot withdraw without incurring penalties. As a prospective buyer, you should make sure your finances are in order and obtain bond pre-approval before making an offer. Whether buyer or seller, be aware of clauses such as the 72-hour clause.

The offer to purchase is a document signed by the buyer and seller that stipulates conditions that need to be met for the purchase to go ahead. Once the document is signed, the buyer applies for a home loan from the bank. Once the home loan is approved, the bond registration and transfer of property takes place.

The Alienation of Land Act No. 68 of 1981(the Act), provides that an agreement for the sale of immovable property, commonly known as an Offer to Purchase must be in writing and signed by both parties being the Seller(s) and the Purchaser(s).

Most commonly, the offer is prepared and extended by the buyer, to the seller. But a seller can also extend an offer to sell, to a potential buyer. In either event, until the offer expiration date, the recipient of the offer has the right to accept the offer, which creates a binding contract.
