| UPDATED: August 8, 2023 at p.m. New protections for Colorado tenants went into effect Monday, covering what landlords can insert into lease agreements and capping costs associated with renting an apartment here.

It is never legal for a landlord to evict a tenant without a court order. The period for a Notice to Quit is 3, 21, 28, or 91 days, depending on the length of tenancy and how much notice is included in the lease. (Colorado Revised Statute 13-40-107.)

A tenancy for one year or longer: 90 days' notice 2. A tenancy between 6-12 months: 28 days' notice 3. A tenancy between one and six months: 21 days' notice 4. A tenancy between one week and one month, or a tenancy at will: 3 days' notice.

In the state of Colorado, the amount of notice needed from a tenant wishing to end a lease is 91 days for a yearly lease, 28 days for 6 months-a year lease, 21 days for a monthly lease, and 3 days for a weekly lease. In the lease agreement, you should also outline your responsibility as a landlord to re-rent the unit.

A Colorado 21 Day Notice to Vacate is a lease termination letter used by either party to end a tenancy of one (1) month or longer, but less than six (6) months. The notice must be provided at least twenty one (21) calendar days prior to the termination date.

Notice to Quit for Substantial Violation. A substantial violation is generally a violent or anti-social act that makes the tenant unsuitable to rent. There is no defense for a substantial violation. This notice only requires three days of notice before termination of the tenancy.

A landlord or property manager in Colorado can use the Colorado Landlord Notice to Vacate Form when they want a tenant to vacate the rental property at the end of their lease (or leave in 30 days or more if there is no lease).

Colorado landlords can't raise the rent during the term of a lease unless the lease specifically allows them to do so. And, Colorado landlords can't increase the rent more than one time in any 12-month period of consecutive occupancy by the tenant.
