Image copyright is the legal ownership of an image. Anyone who creates an image holds its copyright, including the exclusive rights to copy or reproduce it. This is automatic: Copyright exists even if the creator never registers their work with a copyright office. Image copyright exists as soon as an image is created.

The person who creates an image (?the creator?) will generally be the first owner of the copyright. However, there are various situations in which this is not necessarily the case. For photos, it may depend on when the photo was taken, as different rules may apply if the photograph was taken before 1989.

As previously mentioned, copyright protection for a photograph begins as soon as it is fixed in a tangible medium. So, while a photographer does not need to register a photograph with the U.S. Copyright Office for that work to be protected by copyright, there are still many benefits to registering with the Office.

A location, filming, or photography permit is simply permission from a landowner, be it an individual, organization, business, or government agency, to shoot a specific project in a specific place on their property during a specific timeframe.

But knowing how to copyright an image is essential for professional photographers. Just like you would insure your gear before you take it on an overseas vacation, you should always copyright your original work before you publish it on the internet.

Taking photographs on private property is also legal. The landowner may, as a condition of granting entry to the private property, choose to place conditions or restrictions on photography, but the only consequence of failure to comply with these conditions is the photographer being required to leave.

USA Go to the U.S Copyright Office website. Open the menu Registration, then choose Register Your Work: Registration Portal. Register for an eCO account or log in if you already have one. Fill in the application ? a standard application is valid for most types of work, even if it was made for hire or collaborative work.

Registering your image with the US Copyright Office isn't a necessity. But we highly encourage it because registering proves that you own the picture in question. In legal cases, this serves as evidence. Furthermore, if you sue and do not register, you are only entitled to actual damages.
