Let's look at a couple of examples. An insurance contract might be entered into by the parties on January 1, but provide that the effective date of the insurance coverage begins on February 1. Thus, the insured's obligation to pay was created by the contract on January 1.

The date of a contract is established one of two ways?by stating the date in the introductory clause or by having the parties date their signatures. (That's different from stating in the introductory clause a date that reflects the timing of performance; that's a topic for another post.)

An Effective Date in a contract signifies the date which bring the operational clauses concerning the performance of contract, rights, and liabilities of the parties into effect. The Effective Date can be either prospective or retrospective, to the Execution Date.

This is because effective dates can be in the future, meaning that the contract doesn't need to take effect as soon as it's been signed. Rather, organizations can formalize and sign contractual agreements ahead of time, and they can wait for them to come into effect.

While the execution date signifies the moment of contract formation, the effective date determines when the obligations outlined in it come into effect. The effective date will often coincide with the execution date, particularly if the contract is signed and becomes enforceable immediately.

For example, if you're signing a lease, the effective date is usually the day you sign the lease and move in. The start date, on the other hand, is simply the first day of your lease term. In some cases, an effective date and start date may be the same.
