A Building permit is required for any shed over 160 square feet. Building permits are always required for accessory structures that contain plumbing. Other restrictions to consider are set backs from property lines and the overall height of your backyard shed.

You will likely need to apply for a permit. If the unpermitted work is extensive, hire an architect or other professional to draw plans for the current work and propose any changes that need to be made to bring it up to code. Then you will need to get the plan approved by the city.

A building permit is required when: A renovation includes changes to interior or exterior walls and/or existing plumbing system. Structural repairs or changes. Drywall repairs to required fire separations. Altering a garage, or shed over 20 m2 (215 square feet) or over one story.

If you're unsure whether you need a permit, contact the Building Department to find out. Fees for building without a Building Permit are equal to a permit fee or a minimum $100.00. Penalties of up to $50,000 upon conviction for illegal construction may apply per the Ontario Building Code Act.

Regardless of the deck's walking surface area, if the deck is adjacent to or attached to the house and its walking surface is more than 600 mm (24 in.) above the adjacent grade, a permit is required.

Is a building permit required? The Ontario Building Code was recently changed to allow for sheds up to 160 square feet to be built WITHOUT a building permit. An individual who is charged and found guilty of an offence under the Building Code Act, 1992 , such as building without a permit, can be fined up to $50,000 for a first offence and up to $100,000 for subsequent offences.

There are consequences for not getting a permit. You could face a fine, or the municipality may force you to remove walls, ceilings, cabinets and other finishes so that an inspector can determine if the work complies with the building requirements. In the worst case, they'll have the renovation removed entirely.
