Incorporate Age Contract For Free

Since 1969 the age of contractual capacity for individuals has been set at 18 and reaching the age of 18 is known as attaining 'majority'. Minors are therefore those who have not attained the age of 18.

In most states, minors (i.e. individuals under 18) are considered to have mental deficiency and as such, lack the ability to enter into contracts. Therefore, minors are allowed to sign contracts, but they can choose to either void the contract or honor it.

Until a person is the age of majority, they cannot create a contract and can void any contract they enter. Instead, the minor's parent or guardian can enter or create a contract on that person's behalf.

Contracts. Generally, if you are under 18 you cannot enter into contracts. Contracts are legally binding agreements where something valuable is exchanged.

Who can Enter into a Contract? Generally, only individuals with legal capacity can enter into a contract. This means that minors, persons of unsound mind, and persons deprived of civil rights are not capable of contracting. (Civil Code section 1556.)

Firstly, notice of the terms should be given before or during the agreement of the contract. Secondly, the terms must be found in a document intended to be contractual. Thirdly, "reasonable steps" must be taken by the party who forms the term to bring it to the attention of the other party.

A minor can therefore, enter into a contract. However, the law also assumes that a minor cannot understand the implications of a contract. So, whatever caveat is drafted into the contract, they will remain protected to the disadvantage of the other party. Further, a contract with a minor is voidable.

Minors do not have the legal capacity to enter into a binding contract. However, an agreement made while a person was a minor may be expressly or impliedly ratified once they reach the age of legal majority so that the agreement becomes valid and binding. The age of legal majority is separate from legal age of license.
