The governor of California signed SB 793, a bill that banned the sale of tobacco and vapor products in flavors other than ?tobacco? on August 28, 2020. In January 2021, a referendum suspended the ban until voters decide to repeal or affirm it in November 2022.

Government has no plans to impose excise tax on vaping products.

The alcoholic beverage tax is a per-gallon excise tax collected on the sale, distribution, or importation of alcoholic beverages in California. The CDTFA collects the tax and administers the program in cooperation with the Board of Equalization.

Beginning July 1, 2022, electronic cigarette retailers are required to collect from the purchaser at the time of sale, a California Electronic Cigarette Excise Tax (CECET) at the rate of 12.5 percent of the retail selling price of electronic cigarettes containing or sold with nicotine.

California includes vapor products containing nicotine in its definition of ?tobacco product.? Electronic cigarette cartridges and solutions for filling electronic cigarettes must be sold in child-resistant packaging. It is against the law to sell or give tobacco and vapor products to anyone under the age of 21.
