The design must be new. An identical design (or a design differing in immaterial details only) must not have been disclosed to the public anywhere in the world prior to the relevant date (which will usually be the date of application for registration). The design must have individual character.

Like patents, a registered design right gives the owner a monopoly in their design and the right to take legal action to prevent others from exploiting a product identical or similar to that registered without the owner's consent.

The duration of registration of design is initially ten years from the date of registration. However, it can be extended by a further period of five years on an application to be made before the expiry of initial ten years.

You must renew your design registration every 5 years to keep it protected - up to a maximum of 25 years.

A registered design lasts for an initial period of five years. A renewal fee is then payable every five years up to a maximum of 25 years in total. Is it possible to obtain corresponding protection abroad?

The design must be distinctive. It must not be substantially similar to another design. The design must not have been publicly disclosed. If you have sold the product with the design or pattern, or shared a copy of the design, it may be disqualified from meeting the requirements of being new and distinctive.

Designs that can be Registered The design should be new or original, not previously published or used in any country before the date of application for registration. The design should relate to features of shape, configuration, pattern or ornamentation applied or applicable to an article.

A registered design lasts 5 years. You can renew your registration for another 5 years before the expiration date. As it can only be renewed once, the maximum duration of a registered design is 10 years.
