To take someone's name off a deed, a new deed must be prepared to transfer the property from all of the current owners to all of the remaining owners.

A Maryland quitclaim deed gives the new owner whatever right, title, and interest the current owner holds in the property with no covenants of title or warranty. The new owner receives the property ?on an as is, where is basis? and bears all risk of title problems.

It is generally okay to have two names on title and one on the mortgage. If your name is on the deed but not the mortgage, it means that you are an owner of the home, but are not liable for the mortgage loan and the resulting payments.

To change the names on a real estate deed, you will need to file a new deed with the Division of Land Records in the Circuit Court for the county where the property is located. The clerk will record the new deed.

In the case of divorce and gifting, the party who has legal rights of ownership to the property will file a deed transfer or a quitclaim deed, granting full ownership to another party. This will effectively remove the prior owner from the deed and deny him or her any additional rights to the property.
