If you have a fixed term agreement, this means that you have agreed to rent your home for a certain period of time. If you want to move out on the day that the fixed term agreement runs out, you generally don't have to give notice to your landlord.

To serve the notice, you'll need to fill out form 6a and then serve it to the tenant. 'Serving' the notice means making sure the tenant receives it. You'll need to be able to prove that the tenant received your notice forms for your eviction to have a chance if it goes to court.

Landlords do not particularly like break clauses, because they remove the certainty that the premises are let for the period of the lease and if break clauses are exercised, the Landlord can find the property being handed back earlier than planned.

If you end your tenancy it ends for everyone. If your fixed term joint tenancy has a break clause you have to get all the tenants to agree to end the tenancy, unless your agreement says otherwise.

Notice periods for break clauses are usually two months. So, if you started a 12-month tenancy agreement in January and have a six-month break clause, you would need to give your landlord notice in May should you wish to leave at the six-month point in July.

Break clauses aren't compulsory in tenancy agreements and, as such, most standard agreements won't contain a break clause unless requested. If the landlord or tenant agree a break clause, the terms will be inserted into the tenancy agreement.

Unless the lease states that the notice must be given as a deed, the break notice will be valid if it is signed by a director or other authorised officer of the company.

A property management company effectively validated a break clause notice by accepting it as an email even though the lease required more formal notification.

Break provisions allow tenants and landlords the right to terminate their lease before the expiry of a fixed term. A break clause is usually exercised on a fixed date during the lease term although rolling breaks, which are exercisable at any time during the term, can also be agreed.

Your landlord can end the let at any time by serving a written 'notice to quit'. The notice period will depend on the tenancy or agreement, but is often at least 4 weeks.
