Form AU-11, Application for Credit or Refund of Sales or Use Tax, is the most commonly used refund form. You may submit this form using Sales Tax Web File if you have an Online Services account for your business.

You can also request a sales tax refund from the New York State Department of Taxation and Finance by filling out Form AU-11 ("Application for Credit or Refund of Sales or Use Tax") and sending it to the address indicated on the form.

Instead, a sales and use tax is common in most U.S. states. Neither JFK Airport nor New York state provide sales tax refunds. The state of Texas and some areas within Louisiana are the only U.S. locations that provide tax refunds to international shoppers.

Tax credits can only be sold once. Thus, a buyer cannot resell the tax credits it purchases. The buyer must pay cash. Tax credits that are carried into a year from another year cannot be sold.

Forms to File You must file Form 1040, US Individual Income Tax Return or Form 1040 SR, U.S. Tax Return for Seniors. If you have a qualifying child, you must also file the Schedule EIC (Form 1040 or 1040-SR), Earned Income Credit to give us information about them.

The Tax Law exempts purchases for resale; most sales to or by the federal and New York State governments, charitable organizations, and certain other exempt organizations; sales of most food for home consumption; and sales of prescription and nonprescription medicines. Sales tax also does not apply to most services.

Where to file a claim for credit. You should claim your sales tax credit on your return and file your return as you normally would, either using Web File or by mail. Form AU-11 and, if required, Form POA-1 can be filed online.
