NON-TAXABLE FOOD ITEMS The term does not include tobacco, alcoholic beverages, candy, dietary supplements, or soft drinks. The Indiana sales tax does not apply to the sale of food and food ingredients if they are sold unheated and without eating utensils provided by the seller.

The Indiana (IN) state sales tax rate is currently 7%.

Thus, taxable items such as candy and soft drinks are not subject to tax when purchased with food stamps. Sales of disposable household paper products such as towels, napkins, toilet tissue, diapers, paper plates, and cups are exempt from sales tax.

Indiana capps property tax rates at 1% of the value for residential property, 2% of the value for rental property and farmland, and 3% of the value for all other types.

Generally, food and food products sold by food stores are exempt from sales tax. However, there are exceptions. Indiana nonprofit organizations making tax-exempt qualified purchases, but not making retail sales, also must register with the Nonprofit Section of the Indiana Department of Revenue and receive a taxpayer identification number.

Nonprofits are also exempt from paying sales tax and property tax. While the income of a nonprofit organization may not be subject to federal taxes, nonprofit organizations do pay employee taxes (Social Security and Medicare) just like any for-profit company.

Generally, no more than 35 percent of the club's revenues can come from non-member sources. Additionally, a 501(c)(7) club could be subject to taxation or lose its tax exempt status if it engages in business outside of its exempt purpose or if it receives too much income from non-members.

Please note: Being organized and operated as a not-for-profit organization does not, by itself, qualify an organization as a sales tax exempt organization. Religious, charitable, educational, and other organizations must apply to the Tax Department to obtain sales tax exempt status.

To receive an Indiana sales tax exemption, the organization must file a Nonprofit Application for Sales Tax Exemption (Form NP-20A) and annually file a Nonprofit Organization's Annual Report (Form NP-20) with the Indiana Department of Revenue.
