What is a Petition to Determine Parental Relationship? In California, parties who share a child together and are not married can file a petition to determine parental relationship (FL-200) in family court in order to commence a court case to get child custody orders and child support orders.

Child custody interference, also known as custodial interference, occurs when one parent attempts to disrupt the custody rights of the other parent. If the other parent has interfered with the agreement, you have the right to report the incident to the court as well as to law enforcement.

Remember, as long as legal paternity has been established, an unmarried father retains all the same rights and protections as a married father. That means that if you are the custodial parent (meaning that you reside with the child more than 50% of the time), you may be entitled to child support.

File your forms with the court clerk within 30 days of being served with the Petition. Turn in your forms to the court clerk. He or she will keep the original and return the copies to you, stamped “Filed.” One copy is for you and the other is for the petitioner (the other parent). You will have to pay a filing fee.

The term custodial parent refers to the parent with whom the child spends the majority of his or her time. Non-custodial parents, however, still have rights and responsibilities. In California, the courts like to give children equal time with each parent when possible and appropriate.
