Advantages of Filing Separate Returns By using the Married Filing Separately filing status, you will keep your own tax liability separate from your spouse's tax liability. When you file a joint return, you will each be responsible for your combined tax bill (if either of you owes taxes).

Filing status The IRS considers you married for the entire tax year when you have no separation maintenance decree by the final day of the year. If you are married by IRS standards, you can only choose "married filing jointly" or "married filing separately" status. You cannot file as "single" or "head of household."

However, the IRS also allows couples who aren't legally married but are considered married by common law to also file jointly. As of publication, only 10 U.S. states, plus the District of Columbia, recognize common law marriages.
