How do you terminate a purchase agreement? This varies from state to state, but there's usually a purchase cancellation form that has to be filled out and signed by both parties, and then the termination takes effect within 15-30 days.

Subd. Either the purchaser or the seller may cancel a purchase agreement for residential real property under this section.

In order to cancel it, the parties must either mutually agree in writing, or one of the parties must do a Statutory Cancellation pursuant to MN Statute 559.217, or one of the parties must obtain a court order stating the purchase agreement is canceled.

HOWEVER, IF WITHIN THE TIME PERIOD SPECIFIED IN THIS NOTICE YOU SERVE YOUR OWN NOTICE UNDER MINNESOTA STATUTES, SECTION 559.217, YOUR PURCHASE AGREEMENT WILL BE IMMEDIATELY CANCELED, BUT YOUR ENTITLEMENT TO EARNEST MONEY MUST BE DETERMINED BY A COURT OR DETERMINED BY ARBITRATION IF AGREED TO BY THE PARTIES.

Pursuant to Minnesota Statutes, Section 559.217, Subd. 2, either the buyer, or the seller, may cancel a purchase agreement for residential real property pursuant to Minnesota Statutes, Section 559.217.
