A pauper's affidavit is used by a tenant to escape the burden of paying for the “court cost” associated with an appeal. The affidavit is essentially a statement under oath that the tenant is too poor and incapable of paying a few hundred dollars to the State of Texas.

Texas law provides that every county in the state have a Small Claims Court as a forum for settling legal disputes involving cases for money damages up to $10,000. It costs approximately $85 to file a case. You can represent yourself in Small Claims Court or have an attorney.

A Small Claims Case is a lawsuit brought for the recovery of money damages, personal property, or other relief allowed by law. The claim can be for no more than $20,000 (or $10,000 if the case was filed prior to September 1, 2020), including attorney fees, if any, and excluding statutory interest and court costs.

In Harris County, claims of up to $20,000 are allowed in Justice of the Peace (small claims) Court.

The Small Claims Court in Texas is created under Chapter 28 of the Texas Government Code. It has concurrent jurisdiction with the Justice Court in actions by any person for the recovery of money in which the amount involved, exclusive of costs, does not exceed $20,000.00.

Use this form to ask the court not to charge you for court fees. This form is also called an “Affidavit of Inability to Pay Court Costs” or a “Pauper's Oath.” You can only use this form if: (1) you get public benefits because you are poor or (2) you can't pay court fees.

Go to the Harris County District Court closest to you. Obtain the Request Change of Name application form and fill it out. File the Request Change of Name form and pay the $217 filing fee. You will need to show proof of residence and identification while doing so.
