There is no limit of liability for employees subject to the New York Workers Compensation Law.

Sole-Proprietors included on workers' compensation coverage must use a minimum payroll amount of $37,700 and a maximum payroll amount of $114,400 for rating their overall workers' compensation cost. Partners and LLC must be included at a minimum of $45,500 and a maximum of $135,200 for 2023.

Compensation Rates An injured employee is entitled to a compensation rate equal to two-thirds of the average weekly wage (AWW) in New York State for the 52-week period immediately prior to the date of accident. The rate is subject to prescribed maximums and degree of disability.

Workers' Compensation coverage is not required if the business is a one or two person owned corporation, with those individuals owning all of the stock and holding all offices of the corporation (each individual must hold an office and own at least one share of stock).

Each region of the United States has states with low and high costs. For example, although California has one of the highest rates for workers' compensation insurance at $1.45 per $100 in employee wages, the states that border it (Arizona, Nevada, and Oregon) all have costs at $1.00 or less.
