Water Act approvals are required when an activity will impact a water body or when the works will divert and use surface or groundwater. Both Alberta Environment and Parks (AEP) and the Alberta Energy Regulators (AER) grant approvals, licences, and codes of practice through the Water Act.

Surface water includes any freshwater that's sent into wetlands, stream systems, and lakes. On the other hand, groundwater exists in subterranean aquifers that are situated underground. Most groundwater is obtained from snowmelt and rainfall that gets into the bedrock via the surrounding soil.

Groundwater is the water found underground in the cracks and spaces in soil, sand, and rock. It is held in aquifers—permeable water-bearing rock and/or sediment—and can be extracted through wells or bubbles up naturally through a spring or is discharged into lakes or streams.

The Water Act protects water for household and agricultural use and no licence is needed for either type of diversion. For Water Act Code of Practice notices, applications must be submitted through the Digital Regulatory Assurance System.

The purpose of the act is to promote the conservation and management of water while recognizing the need for economic growth and prosperity and flexible management that works cooperatively with governments of other jurisdictions.
