14.05 (1) An offer to settle may be accepted by serving an acceptance of an offer to settle on the party who made it, at any time before it is withdrawn or before the court disposes of the claim in respect of which it is made.

To submit a valid Rule 49 offer to settle, some formal requirements must be met. The offer must be in writing, effectively delivered to the opposing party, and a proposal that can be construed as an offer to settle, open for acceptance and binding if accepted.

The concept of small claims involves the litigation of civil cases where the claim does not exceed a specified amount, currently set at PHP 1,000,000.

◼ Rule 49.02(1) (2021 CanLIIDocs 2041) states that a party to a “proceeding” may serve on any other party an offer to settle any one or more of the claims in the proceeding on the terms specified in the offer to settle. Rule 1.03 defines a “proceeding” to mean an action or application.

An offer to settle usually includes a statement by the plaintiff or defendant about how they are willing to resolve the lawsuit without going to trial. An offer to settle can be made by anyone involved in a lawsuit at any time. An offer to settle can be withdrawn as long as it has not been accepted by the other side.
