If you rehire a former employee when three years has passed since the original Form I-9 was completed, you should treat as a new employee. You will complete Form I-9 again and verify the new hire in E-Verify.

6.2 Reverifying or Updating Employment Authorization for Rehired Employees. If you rehire employees within three years from the date you completed their previous Form I-9, you may complete a block on Supplement B, Reverification and Rehire, or you instead complete a new Form I-9.

You must complete a new Form I-9 when a hire takes place, unless you are rehiring an employee within three years of the date the employee's previous Form I-9 was completed.

As an HR professional, you must verify the employee's identity and employment authorization by filling out Form I-9. A new record is needed if the rehire is over three years from their previous employment date.

When you must reverify an employee, you will complete one block of Supplement B, Reverification and Rehire (formerly Section 3) and attach it to the employee's original Form I-9.
