Law enforcement at the scene of an accident will fill out a CR-3 form – also called a Texas Peace Officer's Crash Report. However, if they were not present or if you were involved in a minor accident, they may have given you a CR-2 form to fill out yourself.

Under the Texas Transportation Code Ann. § 550.022, a driver who damages another vehicle or other property must immediately—along with any other drivers: Stop the vehicle at the scene of the collision or as close as possible so that you do not obstruct more traffic than necessary.

Severity of damage: This represents how much damage a vehicle has endured. Typically, the number scale is between one and six. The more damage a vehicle has endured, the higher the number will be.

This form is to be used when the driver of a motor vehicle is involved in a crash not investigated by a law enforcement officer that results in injury to or death of any person, or damage to the property of any one person, including the driver, to the apparent extent of at least one thousand dollars ($1,000).

If you leave the scene of an accident, and someone was either seriously injured or died in the accident, you could be charged with a third-degree felony. Under § 12.34 of the Texas Penal Code, a conviction carries a fine of up to $10,000 and prison between two and ten years.

Code § 550.022: An accident involving damage less than $200 can result in a Class C misdemeanor, which is punishable by a fine of not more than $500; and. An accident involving more than $200 in damage can result in Class B misdemeanor, which is punishable by up to 180 days in jail and/or a fine up to $2,000.
