The new Maryland law requires universities to have a privacy governance and risk management program in place. This is designed to help institutions comply with important data privacy regulations, protect sensitive information (data encryption is also mandated), and properly manage security risks.

Under FERPA, schools are responsible for protecting student records, whether they are stored electronically or in paper form. A violation occurs when schools allow unauthorized personnel to access these documents on purpose or by mistake.

These records include but are not limited to grades, transcripts, class lists, student course schedules, health records (at the K-12 level), student financial information (at the postsecondary level), and student discipline files.

FERPA serves a two-fold purpose: (1) to grant parents (and students 18 or older) access to information in the student's education record, and (2) to protect that information from disclosure to third parties without parental consent.

A school shall maintain all records of a student for at least 5 years after a student either terminates training or graduates. After that, a school is only required to maintain the student records identified in §A of this regulation in a form and manner approved by the Secretary.

In the United States, three student privacy laws have been enacted to uphold student privacy and data security: the Family Educational Rights & Privacy Act (FERPA), the Children's Online Privacy Protection Act (COPPA), and the Children's Internet Protection Act (CIPA).

FERPA provides that educational institutions, such as postsecondary institutions, may disclose education records, or personally identifiable information from such records, only if an eligible student has provided prior written consent, except in several specified circumstances policy III-6.30(A).
